
Representative Work Includes:
- Prosecuting and defending multi-party, multi-issue lien claims
- Arbitrating and mediating construction disputes
- Defending building inspectors and other municipal procurement staff
- Arbitrating a dispute between a municipality and it’s civil contractor over contract extras
- Arbitrating disputes arising from infrastructure and transit development
- Strategic advice on the consequences of the Occupational Health & Safety Act issues
- Advising a governmental authority on the alleged malicious prosecution of the municipal bylaw and successfully overturning stay proceedings
- Successful mediation of many construction disputes including claims for extras, claims of deficient work and claims of negligent design
- Prosecuting claims against surety companies under performance bonds, and labor material payment bonds
- Defending surety companies against claims made under performance bonds, and labor material payment bonds
- Advising lawyers and their insurers, and defending allegations of errors and omissions in construction practice
- Advising design professionals on their service agreement
- Advising bidders on their responses to tender calls and to advising on negotiations and strategy with tender authorities
- Attending at multi-party, multi-issue Coroner’s Inquests
- Defending professionals before their regulatory bodies including the Law Society of Upper Canada, the Professional Engineers of Ontario and the Ontario Association of Architects
